1. Agreement to Terms

By accessing or using AntForms ("Service") at antforms.com, app.antforms.com, or related domains, you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service. In these Terms, "AntForms," "we," "us," and "our" refer to the company operating the Service and include its affiliates and its and their officers, directors, employees, agents, founders, and licensors, each of whom may rely on and enforce the disclaimers, limitations of liability, and indemnification in these Terms.

2. Description of Service

AntForms provides an online form builder that allows you to create, publish, and manage forms and collect responses. Features may include templates, logic and branching, analytics, integrations, and related tools. We may add, change, or discontinue features at any time without liability. We strive to keep the Service available but do not guarantee uninterrupted, error-free, or secure access. We do not guarantee any particular result, compliance with law, or fitness for your specific purpose. You use the Service at your own risk.

3. Account and Eligibility

You must:

  • Provide accurate registration information and keep it up to date
  • Maintain the security of your account credentials
  • Be at least 16 years old (or the age of consent in your jurisdiction) to use the Service

You are responsible for all activity under your account. Notify us promptly at support@antforms.com if you suspect unauthorized use.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe or misappropriate others' intellectual property, privacy, or other rights
  • Collect personal data from respondents without a lawful basis and, where required, consent
  • Distribute malware, spam, or phishing, or engage in fraudulent activity
  • Overwhelm or disrupt the Service (e.g., abuse of APIs or automated requests)
  • Resell or sublicense the Service in a manner that conflicts with these Terms unless we agree in writing

We may suspend or terminate accounts that we reasonably believe violate these Terms or harm the Service or others, with or without notice. We have no liability to you or any third party for any suspension or termination.

5. Your Content and Data

You retain ownership of the forms, questions, and content you create ("Your Content") and the responses you collect ("Response Data") to the extent you have rights in them. You grant us a limited license to host, store, process, and display Your Content and Response Data as necessary to provide and improve the Service and as described in our Privacy Policy. You are solely responsible for ensuring that Your Content and collection of Response Data comply with applicable law and that you have appropriate rights or consent from respondents.

You are the data controller for Response Data; we process it only as your processor. Any claim, complaint, or regulatory action by or against a respondent or authority regarding Response Data or your collection practices is your sole responsibility. We are not liable for such claims or for your failure to comply with data protection or privacy laws.

6. Our Intellectual Property

AntForms and its branding, product design, and technology are owned by us or our licensors. These Terms do not grant you any right to our trademarks, logos, or code except as necessary to use the Service in accordance with these Terms.

7. Fees and Payment

We may offer free and paid plans. For paid plans, fees and billing terms will be presented at signup or in the app. You agree to pay all applicable fees. We may change pricing with notice; continued use after the change constitutes acceptance. Refund policy will be stated at purchase or in the app. We are not obligated to provide refunds except as stated there.

8. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or for operational or legal reasons, with or without notice. Upon termination, your right to use the Service ends immediately. We have no liability to you for any termination. We may retain and use your data as described in our Privacy Policy (e.g., for legal or backup purposes). You may export your data before closure where the product allows; we are not obligated to retain or provide access after a reasonable period following closure.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, SECURE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS. WE DO NOT GUARANTEE ANY PARTICULAR RESULT, COMPLIANCE WITH LAW, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS. YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.

We are not responsible for the content of Your Content or Response Data, for actions taken by respondents or third parties, or for your use of the Service in violation of law. No advice or information from us, whether oral or written, creates any warranty not expressly stated here.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANTFORMS, ITS AFFILIATES, OR ITS OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, FOUNDERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, OR FOR COST OF COVER OR SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, THE SERVICE, YOUR USE OR INABILITY TO USE THE SERVICE, YOUR CONTENT, RESPONSE DATA, OR ANY THIRD-PARTY CONDUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100). MULTIPLE CLAIMS WILL NOT EXPAND THIS LIMIT.

THE LIMITATIONS IN THIS SECTION APPLY TO ALL THEORIES OF LIABILITY, INCLUDING BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, AND STATUTORY CLAIMS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW (E.G., IN SOME JURISDICTIONS, LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE).

11. Indemnification

You agree to indemnify, defend, and hold harmless AntForms and its affiliates and its and their officers, directors, employees, agents, founders, and licensors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and costs) arising out of or related to: (a) your use of the Service; (b) Your Content or Response Data; (c) your violation of these Terms or any applicable law; (d) your violation of any third-party right, including intellectual property or privacy rights; (e) any claim by a respondent or regulatory authority regarding data you collect or process via the Service; (f) any dispute between you and a respondent or third party; or (g) any claim that your use of the Service caused harm to a third party. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you (at your expense), and you agree to cooperate with us. You will not settle any claim that affects us or imposes obligations on us without our prior written consent.

12. Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riot, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

13. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which AntForms operates, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of that jurisdiction, and you consent to personal jurisdiction and venue there. Nothing in these Terms affects your statutory rights as a consumer in your jurisdiction where such rights cannot be waived by contract.

14. Severability; Entire Agreement; No Waiver; Assignment

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

Entire agreement. These Terms, together with our Privacy Policy and any order or policy referenced herein, constitute the entire agreement between you and AntForms regarding the Service and supersede all prior agreements and understandings.

No waiver. Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.

Assignment. We may assign or transfer these Terms or our rights and obligations hereunder, in whole or in part, without your consent. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. Any attempted assignment in violation of this section is void.

15. Changes

We may modify these Terms from time to time. We will post the updated Terms on this page and indicate the effective date. Material changes may be communicated via the Service or email. Continued use of the Service after the effective date constitutes acceptance. If you do not agree, you must stop using the Service and close your account.
